By registering to bid in this online auction, you acknowledge, accept, and agree to the following Terms & Conditions. Bidding in this auction constitutes a binding legal agreement between the bidder and Ryan Cate Auctions & Real Estate, LLC (“Auctioneer”).
Personal Property: Terms & Conditions – Please Read Carefully!
By registering and bidding, you agree to follow all of the auction terms and conditions, make payment, and take possession of item(s) bid on.
1. Registration & Bidding Eligibility
- All Bidders must be at least 18 years of age and legally capable of entering into a binding legal agreement.
- A valid credit/debit card is required to register.
- The Auctioneer reserves the right to approve or deny bidder registration at their discretion.
2. Internet & Software Disclaimer
Although the auction company strives to provide the best internet connection and software available, please understand that internet speeds and reliability can vary.
The auction company is not responsible for lost connection or software failure resulting in unaccepted or lost bids.
3. Auctioneer Rights
Auctioneer reserves the right to reject or cancel any bid placed or withdraw any item at any time.
4. Email Database
Auction Company will add all bidder registration email addresses to Auction Company Database.
Bidders can opt out of service at any time.
5. Buyer’s Premium
- There is a 15% Buyer’s Premium charged on the final/winning bid amount payable by the Buyer/Winning Bidder to the Auction Company at close of auction.
- The Buyer’s Premium may vary by item/auction and will be disclosed in the auction listing.
6. Payment Terms
- Payment is due IN FULL within 24 hours of the auction closing.
- Non-Payment equals immediate forfeiture of lots won. Any winning bid and associated fees are subject to automatically be charged to your credit card on file.
- Accepted forms of payment include all major credit cards/debit card, wire transfer, cash, or certified check.
- A 3.99% Credit Card Processing Fee will be applied to all Credit Card Transactions.
- A $25 Wire Transfer Fee will be applied to all Wire Transfers.
- Winning bidders will receive an invoice by email.
- There are no chargebacks on credit card purchases.
- Bidders are advised to make financial arrangements prior to placing any bid. Any cost/fees associated with Buyer/Winning Bidder financing is at the sole expense of the Buyer/Winning Bidder.
- Late or failed payment may result in forfeiture of the item and banning from future auctions.
7. Sales Tax
- All sales are subject to 7% Indiana Sales Tax.
- Applicable sales tax will be charged unless a valid resale or exemption certificate is provided preferably before end of auction.
8. All Sales Final
All sales are final. NO REFUNDS WILL BE GIVEN on any purchase/winning bid or associated fees.
9. Transfer of Ownership & Possession
When an item is SOLD, it immediately becomes the property and responsibility of the Buyer/Winning Bidder.
A winning bid constitutes a binding contract and Buyer/Winning Bidder is required to pay for AND take possession of any and all items they successfully bid on/win.
Seller(s) and auction company are not responsible for moving or shipping items or for any cost associated with Buyer/Winning Bidder taking possession of item(s).
Buyer/Winning Bidder must take possession of item(s) within 3 days of close of auction (unless otherwise scheduled with Auction Company).
If Buyer/Winning Bidder does not take possession of item(s) within 3 days of close of auction, Buyer/Winning Bidder forfeits item(s) back to Seller(s) and no refund will be given.
10. Item Condition & Warranties
All items will be sold in “AS-IS” condition with all faults and limitations and with no warranties express or implied.
The Buyer/Bidder is responsible for determining their own opinion of the condition and authenticity of any and all items and is encouraged to do so prior to placing any bid.
The seller(s), auction company and their representatives make no representation or warranty to Buyer/Bidder, either express or implied, as to the condition of the items or the suitability of the items for Buyer/Bidder’s intended use or purpose or for any other use or purpose.
Any information provided regarding the items is deemed to be reliable but is not guaranteed and should not be substituted for the Buyer’s/Bidder’s independent verification and investigation of the items.
The seller(s), auction company and their representatives disclaim any warranty or liability for information provided.
Buyer/Bidder understands, accepts and agrees that Buyer/Bidder has been advised to seek appropriate counsel regarding the risks of buying items in “AS-IS” condition.

1. Agreement to Terms
By registering and bidding, you agree to follow all of the auction terms and conditions.

3. Binding Offer
Any bid placed shall constitute a legally binding and enforceable offer to purchase the subject Real Estate.
Auctioneer reserves the right to reject or cancel any bid placed.
4. Buyer’s Premium & Fees
- A 10% Buyer’s Premium will be charged to the final/winning bid price, payable by the Buyer/Winning Bidder to Ryan Cate Auctions & Real Estate.
- A $117 Broker Compliance Fee will be charged to the Buyer/Winning Bidder at closing.
5. Purchase Agreement
The Winning Bidder will be notified upon close of auction.
Within 24 hours, the Buyer/Winning Bidder must execute a Purchase Agreement and any applicable documents including Addendums, Disclosures, Waivers, Agreements, Clauses, and/or Broker Forms.
These documents are non-negotiable, and time is of the essence.
6. Closing Location
Closing and title work will be completed by Abstracts of Richmond, located at 25 North 8th Street, Richmond, IN 47374.
7. Closing Deadline
The real estate transaction must close within 30 days of the auction close unless otherwise agreed upon by Seller and Buyer/Winning Bidder.
8. Possession
Possession of the real estate will be negotiable between the Buyer and Seller.
9. Closing Costs
Closing costs/fees will be split evenly between the Seller and Buyer/Winning Bidder.
10. Tax Proration
Property taxes will be prorated to the day of closing.
11. Financing Costs
Any financing-related costs/fees are the sole responsibility of the Purchaser/Buyer/Winning Bidder.
12. As-Is Sale – No Contingencies
The Property will be sold "AS-IS", with no contingencies including but not limited to financing, insurance, appraisals, surveys, and inspections.
Bidders are encouraged to inspect the property before bidding.
13. Financial Preparation
Bidders are advised to make necessary financial arrangements prior to bidding.
14. Earnest Money Deposit
A non-refundable earnest money deposit equal to 10% of the purchase price/winning bid is due from the Buyer/Winning Bidder within 48 hours of auction close.
This must be paid to the Title Company and held in escrow until closing.
The deposit is non-refundable unless the Seller defaults.
15. Final Payment
The balance of the purchase price is due in cash at closing, via wire transfer or as otherwise required by the Title Company.
16. Property Condition Disclosure
The property is sold in its “AS-IS” condition with all faults and limitations, with no warranties expressed or implied.
Buyer/Winning Bidder is advised to seek legal or professional counsel about purchasing "AS-IS".
17. No Warranty or Representation
The Seller, Auction Company, Real Estate Broker, and their representatives make no warranties or guarantees (express or implied) regarding property condition, zoning, suitability for use, easements, deed restrictions, or availability of permits or utilities.
18. Independent Verification Advised
Any property information provided is believed to be reliable but is not guaranteed.
Buyers are responsible for independently verifying all property information prior to bidding.
19. Agency Disclosure
Better Homes & Gardens First Realty Group and its representatives are exclusive agents for the Seller.
